Welcome to PacLabel ("PacLabel", "we", "our", or "us"). These Terms & Conditions govern the use of our website and the purchase of products from www.paclabel.co.nz. By accessing our website or placing an order, you agree to be bound by these Terms & Conditions.
General
These Terms & Conditions apply to all sales of goods and services supplied by PacLabel unless otherwise agreed in writing.
We reserve the right to amend these Terms & Conditions at any time. Any changes will take effect once published on our website.
Products
We make every effort to ensure product descriptions, specifications, colours, dimensions, and images are accurate. However, actual products may vary slightly due to manufacturing processes, screen displays, or material variations.
We reserve the right to modify, discontinue, or update products without notice.
Pricing
All prices are displayed in New Zealand Dollars (NZD) and include GST unless otherwise stated.
Prices are subject to change without notice.
If a pricing error occurs, PacLabel reserves the right to cancel or amend an order before dispatch. Customers will be contacted before any action is taken.
Orders
All orders are subject to acceptance by PacLabel.
We reserve the right to decline, cancel, or limit any order at our discretion, including where products are unavailable, pricing errors occur, or fraud is suspected.
Ownership of goods remains with PacLabel until full payment has been received.
Payment
Payment must be received before goods are dispatched unless an approved trade account with agreed credit terms is in place.
Trade account customers must pay invoices in accordance with the agreed payment terms.
PacLabel reserves the right to charge interest on overdue accounts and recover reasonable collection costs where permitted by law.
Artwork Approval
Customers are responsible for reviewing all artwork proofs carefully before approving production.
Written approval, including approval by email, constitutes final approval to proceed with production.
Once artwork has been approved, PacLabel accepts no responsibility for spelling, grammar, layout, sizing, colours, barcodes, logos, or any other errors contained within the approved artwork.
Custom Printed Products
Production of custom products begins only after written artwork approval has been received.
Custom printed, personalised, or made-to-order products cannot be cancelled, changed, returned, or refunded once production has commenced, except where required under the Consumer Guarantees Act 1993.
Printing Tolerances
Customers acknowledge that minor variations in colour, shade, print density, alignment, registration, trimming, dimensions, and finishing are inherent in commercial printing and fall within accepted industry tolerances.
Such variations do not constitute defects.
Label Performance
Label adhesion and performance depend on the application surface, storage conditions, environmental conditions, and method of application.
Customers are responsible for determining that the selected label material and adhesive are suitable for their intended purpose.
PacLabel is not liable for product failure resulting from incorrect application, unsuitable surfaces, improper storage, or misuse.
Shipping and Delivery
Delivery timeframes are estimates only.
PacLabel will use reasonable efforts to dispatch orders promptly but is not liable for delays caused by couriers, suppliers, customs, weather events, or circumstances beyond our reasonable control.
Risk in the goods passes to the customer upon delivery to the nominated delivery address.
Customers are responsible for ensuring delivery details are accurate.
Additional freight charges may apply where goods are returned due to incorrect delivery information or failure to accept delivery.
Returns and Refunds
Unused and unopened standard stock products may be returned within thirty (30) days of delivery, subject to prior approval from PacLabel.
Custom printed, personalised, or made-to-order products cannot be returned unless they are defective, damaged, or incorrectly supplied.
Customers must inspect goods immediately upon delivery and notify PacLabel in writing within seven (7) days of any shortages, incorrect goods, damage, or manufacturing defects.
Where goods are confirmed to be defective or supplied incorrectly by PacLabel, we will, at our discretion and in accordance with New Zealand consumer law:
- Repair the goods;
- Replace the goods; or
- Provide a refund.
Intellectual Property
All website content, including text, graphics, photographs, logos, designs, product information, and trademarks, remains the property of PacLabel unless otherwise stated.
Customers retain ownership of artwork supplied by them.
PacLabel retains ownership of production files, templates, tooling, and design work created during production unless otherwise agreed in writing.
Limitation of Liability
To the maximum extent permitted by law, PacLabel's liability for any claim relating to goods or services supplied is limited to:
- Repair of the goods;
- Replacement of the goods; or
- Refund of the purchase price; or
- Re-supply of the services.
PacLabel shall not be liable for any indirect, consequential, incidental, special, or economic loss, including loss of profits, production, goodwill, or business opportunity.
Force Majeure
PacLabel is not responsible for delays or failure to perform its obligations due to events beyond its reasonable control, including natural disasters, strikes, supplier shortages, pandemics, government restrictions, transport disruptions, or acts of God.
Privacy
Personal information collected through our website is handled in accordance with our Privacy Policy and the Privacy Act 2020.
By using our website, you consent to the collection and use of your information as described in our Privacy Policy.
Website Use
You agree not to:
- Use the website for unlawful purposes.
- Attempt to gain unauthorised access to our systems.
- Introduce malicious software or interfere with website operation.
